Experts consider Elon Musk’s reforms through Doge unconstitutional and illegal. According to legal professionals, he cannot unilaterally alter the operations of government agencies, and such changes require congressional approval.
In 2025, Elon Musk assumed leadership of a newly established division in the U.S. government – Doge (Department of Government Efficiency) – created to "increase efficiency" in government operations. Musk has been rapidly dismissing federal agency employees, significantly cutting government spending, and integrating his personal technological vision into political processes, which has sparked widespread discontent.
With Doge’s establishment, Musk initiated radical changes across various government institutions. He halted the Pentagon’s diversity and inclusion programs and launched an offensive against agencies like the Central Intelligence Agency (CIA) and USAID.
Musk called USAID a “radical leftist political psy-op” and proposed eliminating the agency entirely. However, this decision met strong opposition from Democratic Party members and led to nationwide protests against Doge.
Government layoffs are not only leaving federal employees jobless but also putting Americans' private data at risk.
Developers hired by Doge have been accused of illegally accessing the Treasury Department’s payment system, obtaining personal banking information, Social Security numbers, and other confidential data.
Harvard Law School emeritus professor Laurence Tribe labeled Doge’s operations unconstitutional and emphasized that Musk cannot exert such extensive control over the government.
"This is illegal!" Tribe declared regarding Doge’s expanding powers.
Additionally, Senator Bernie Sanders told CNN that Musk’s actions are illegal and unconstitutional, emphasizing that an agency like USAID cannot be dissolved without congressional approval.
The first lawsuit against Doge was filed in Maryland just minutes after Trump’s inauguration. The court documents argue that Doge should be classified as a “federal advisory committee,” making it subject to government transparency laws and legal accountability for its actions.
